Minor Visitor Liability Waiver

IMPORTANT NOTICE: BY SIGNING THIS AGREEMENT AS PARENT OR LEGAL GUARDIAN OF THE MINOR NAMED IN THIS FORM, YOU MAY BE WAIVING CERTAIN LEGAL RIGHTS FOR YOURSELF AND THE MINOR, INCLUDING THE RIGHT TO RECOVER DAMAGES FOR INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF THE MINOR’S PRESENCE ON THE PROPERTY OR PARTICIPATION IN FARM ANIMAL ACTIVITIES. READ THIS AGREEMENT CAREFULLY BEFORE SIGNING.

In consideration for allowing the minor named in this form to enter, remain on, visit, observe, or participate in activities at the Nadine & Ripley property, ranch, facilities, pastures, barns, corrals, arenas, driveways, parking areas, and surrounding grounds (collectively, the “Property”), I agree as follows:

1. Acknowledgment of Inherent Risks

I understand and acknowledge that horses, donkeys, livestock, ranch dogs, farm animals, and ranch environments are inherently dangerous. Risks may include, without limitation: kicking, biting, bucking, bolting, rearing, stepping on, striking, crushing, dragging, collisions, falls, spooking, unpredictable animal behavior, reactions to people, noise, weather, equipment, vehicles, or other animals, and hazards involving gates, fencing, trailers, tack, tools, tractors, machinery, mud, uneven ground, holes, slippery surfaces, insects, wildlife, dust, hay, allergens, and heat.

2. Voluntary Assumption of Risk on Behalf of Minor

I voluntarily allow the minor named in this form to enter the Property and I knowingly and voluntarily assume, on behalf of myself and the minor, all risks of injury, death, illness, allergic reaction, or property damage arising from or related to the minor’s presence on the Property, whether the minor is visiting, observing, handling an animal, near an animal, participating in any activity, or accompanying another person.

3. Release of Liability

To the fullest extent permitted by Texas law, I release, waive, and discharge Nadine & Ripley, the property owners, operators, family members, agents, representatives, contractors, volunteers, guests, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or related to the minor’s presence on the Property or participation in any ranch or farm animal activity, including claims arising from the ordinary negligence of any Released Party, to the fullest extent permitted by law.

4. Agreement to Follow Rules and Instructions

I agree that the minor and I will follow all posted rules and all verbal instructions given by the Released Parties. I understand that entering restricted areas, approaching animals without permission, feeding animals without permission, or failing to follow safety instructions may increase risk and may result in removal from the Property.

5. Parent / Guardian Authority

I represent and warrant that I am the parent or legal guardian of the minor named in this form, or that I otherwise have legal authority to sign this agreement on the minor’s behalf.

6. Medical Responsibility

I understand that there may not be medical personnel on site. I accept full responsibility for the minor’s medical care, insurance, and emergency expenses. I authorize emergency medical treatment to be sought for the minor if deemed necessary, at my sole cost and expense.

7. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, demands, actions, liabilities, losses, damages, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to my conduct, the minor’s conduct, our presence on the Property, any violation of rules or instructions, or claims brought by or on behalf of the minor, to the fullest extent permitted by law.

8. Texas Farm Animal Warning

WARNING: UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), A FARM ANIMAL PROFESSIONAL OR FARM OWNER OR LESSEE IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN FARM ANIMAL ACTIVITIES, INCLUDING AN EMPLOYEE OR INDEPENDENT CONTRACTOR, RESULTING FROM THE INHERENT RISKS OF FARM ANIMAL ACTIVITIES.

9. Continuing Effect

This agreement applies to the minor’s current visit and all future entries onto the Property unless revoked by the Property owners in writing. If any provision of this agreement is held invalid or unenforceable, the remaining provisions remain in full force and effect.

10. Electronic Signature Consent

I agree that my electronic signature as parent or guardian is intended to be legally binding and has the same force and effect as an original handwritten signature. I acknowledge that I have read this agreement, understand it, and sign it voluntarily on behalf of myself and the minor named in this form.
